Scalia vs. Thomas

In his article today, Paul Craig Roberts reminds us that the late SC justice Scalia was an architect of the police state. This reminds me to point out that Scalia voted in favor of the federal drug war in the infamous Gonzales v. Raich case. It was Justice Thomas who wrote in his dissenting opinion: “Certainly no evidence from the founding suggests that ‘commerce’ included the mere possession of a good or some personal activity that did not involve trade or exchange for value. In the early days of the Republic, it would have been unthinkable that Congress could prohibit the local cultivation, possession, and consumption of marijuana.”
